Si bien existen otros foros de arbitraje alternativos como la <a href=\"https:\/\/es.wikipedia.org\/wiki\/Comisi%C3%B3n_de_las_Naciones_Unidas_para_el_Derecho_Mercantil_Internacional\">Comisi\u00f3n de Naciones Unidas para el Derecho Mercantil Internacional<\/a>\u00a0(UNCITRAL, en sus siglas en ingl\u00e9s), durante los 90, un tercio de los pa\u00edses de Am\u00e9rica Latina y el Caribe (ALC), adhiri\u00f3 al CIADI, como principal foro de resoluci\u00f3n de controversias relacionadas a inversiones extranjeras. Durante la misma d\u00e9cada, los pa\u00edses de la regi\u00f3n suscribieron un n\u00famero importante de tratados bilaterales de inversi\u00f3n (que son utilizados en muchos casos, como sustento de las denuncias ventiladas en el CIADI) pasando de 30 tratados en 1990 a m\u00e1s de 500 en 2019. Actualmente, aproximadamente el 30% de las controversias que se tramitan en el CIADI, corresponden a denuncias contra pa\u00edses de ALC.<\/p>\n<p>Un resultado que se observa en el caso de las controversias resueltas contra pa\u00edses de la regi\u00f3n es que en un 50% estas son favorables a los inversionistas demandantes. No obstante, en el caso de aquellas controversias referidas a expropiaciones directas (nacionalizaciones, embargos, confiscaciones o transferencias forzosas de activos); \u00e9stas son resueltas en contra del Estado demandado en un 67% de los casos. Esto ha llevado a que los pa\u00edses denunciados, por lo general, opten por una soluci\u00f3n negociada con la parte denunciante. Un ejemplo de ello fue la expropiaci\u00f3n de Repsol (YPF) por parte del gobierno argentino en el a\u00f1o 2012. Dos a\u00f1os despu\u00e9s, tras la denuncia de dicha empresa ante el CIADI, se lleg\u00f3 a una soluci\u00f3n negociada en la que se la indemniz\u00f3 por aproximadamente US$ 5 mil millones. Si estos casos conciliados fueran incluidos dentro de los resultados favorables a los inversionistas, el n\u00famero total de laudos adversos superar\u00eda largamente el 50%.<\/p>\n<p>Los efectos de un resultado adverso en el CIADI sobre los pa\u00edses no son solo econ\u00f3micos sino reputacionales, en t\u00e9rminos de su imagen como plaza de atracci\u00f3n de inversiones y del deterioro de la percepci\u00f3n de riesgo asociado a estas.<\/p>\n<p>En el caso del Per\u00fa, si bien hasta el a\u00f1o 2017 el n\u00famero de demandas contra el Estado era relativamente bajo (un total de 17 demandas), desde el 2018 hasta la fecha, el n\u00famero se ha m\u00e1s que duplicado llegando a 36 en total. De este total, 10 corresponde a casos vinculados a infraestructura de transporte, 7 a miner\u00eda y 5 a energ\u00eda el\u00e9ctrica. Un total de 8 controversias corresponde a capitales de origen norteamericano y 5 espa\u00f1ol. Del total de casos concluidos (17), 4 fueron conciliados o desistidos y 13 resueltos. En cuanto a estos \u00faltimos, el ratio de \u00e9xito del Per\u00fa ha sido relativamente alto: en 10 de los casos se obtuvo laudos favorables.
